Firstory Privacy Policy

This policy sets forth the terms, conditions, rights, and obligations between you and Firstory Inc. (hereinafter referred to as "Firstory") regarding the personal data (as defined below) that you provide to Firstory Group companies when you download, install, register, log in, and use Firstory Services (as defined below). Please read this policy carefully to protect your rights.

When you initially register for a Firstory account and enter the webpage displaying the "Firstory Terms of Service," if you continue to register, log in, and use Firstory Services, you (or your legal representative) are deemed to have reviewed and fully understood all such terms of service (including the Firstory User Guidelines, Privacy Policy, Intellectual Property Policy, and Royalty Redemption Terms of Service, hereinafter the same) within a reasonable review period, and you agree to comply with the aforementioned terms of service and policies. You must be at least 20 years old or have reached the legal age of majority in your jurisdiction to continue registering, logging in, and using Firstory Services. If you have not reached the aforementioned legal age, please obtain the consent of your legal representative (such as parents or legal guardians) before registering, logging in, and using Firstory Services.

For any violation or potential violation of this policy, Firstory has the right to independently determine and, as appropriate, immediately terminate all or part of the services provided (including but not limited to prior warnings, stopping the publication or transmission of content, deleting published or transmitted content, restricting some or all account functions up to permanent account closure, and other measures) and take appropriate legal remedies. Firstory has the right to announce the handling results and has the right to decide whether to restore all or part of the services based on actual circumstances. For suspected infringement, criminal activity, or other violations of laws and regulations, relevant records will be retained and provided to competent authorities and their designated internet content protection agencies, and Firstory will cooperate with competent authorities in investigations. Deleted content will not be restored by Firstory. If we disable or delete your account, you fully understand and agree that you will no longer be able to access all your data through your account.

If you cause third-party complaints or lawsuits due to your violation of this policy, you shall bear all legal responsibilities and related expenses. If your illegal or breach of contract behavior causes any Firstory Group company or successor company to compensate any third party or be punished by a state agency, you shall pay a punitive penalty of USD 100,000 to Firstory and must fully compensate all losses suffered by Firstory Group companies and successor companies (including but not limited to reputational losses and economic losses such as government fines, litigation costs, attorney fees, and damages claimed by third parties).

Within the global Firstory service area, Firstory has the right to use personal data for a period not exceeding 2 years after the end of the specific service or activity for which the personal data was collected (but this period may be adjusted based on specific purpose requirements). Provide you with promotional offers regarding online live streaming, online videos, online shopping, and other internet services provided by Firstory through its service software (Firstory App) and service website (https://firstory.me/).
Activity monitoring and data analysis for the use of Firstory Services, preserving transaction records and negotiation processes.

You may choose which personal data items to provide; however, when data is insufficient or incorrect, Firstory will be unable to provide corresponding services, notices, updates, operational messages, promotional offers, etc.

Inquiry, Access, Copy, Supplement, Correction, Cessation of Collection/Processing/Use, and Deletion of Personal Data

Regarding the personal data you provide to Firstory, you may contact Firstory customer service to exercise the following rights (however, Firstory may refuse your request in circumstances prescribed by relevant personal data protection laws and regulations). For the labor costs incurred in processing your request, Firstory may charge a processing fee of NTD 100 per request.

Firstory's Sharing of Your Personal Data with Third Parties

You agree to authorize Firstory Group companies, successor companies, and companies approved by Firstory to jointly use the personal data (such as name, telephone number, email, etc.) you provide or publish when registering or using Firstory Services and its software/website to maintain the quality, richness, and security of Firstory Services. For the avoidance of doubt, you agree that your operations of publishing, modifying, and deleting content on Firstory Services and its software/website may be synchronized to client software and websites (if any) operated by the aforementioned companies. Firstory is responsible for managing the aforementioned personal data.

Cooperative Vendors

To provide you with more efficient services, richer activities, and more secure data management, Firstory will, as necessary, commission professional third parties (such as logistics companies, banks, public relations and marketing companies, information security companies, etc., hereinafter referred to as "Cooperative Vendors") to perform such services and activities, and therefore it is necessary for Cooperative Vendors to access, process, or use your relevant personal data. # Firstory Intellectual Property Policy

This policy sets forth the terms, conditions, rights, and obligations regarding intellectual property/intellectual property rights between you and Firstory Inc. (hereinafter referred to as "Firstory") concerning data on Firstory Services and its software/website and the content you publish on Firstory Services and its software/website (as defined below). Please read this policy carefully to protect your rights.

Definitions

Firstory Services: The Firstory Services referred to in these Terms of Service refer to the internet services provided by Firstory through its service software (Firstory App) and service website (https://studio.firstory.me/). Firstory Group companies and successor companies have the right to make changes to the aforementioned software and websites (including but not limited to renaming, changing domain names, and adding service content).
Firstory Group: Refers collectively to Firstory and its affiliated enterprises.
Firstory Services and its Software/Website: The collective term for Firstory Hosting Services, Firstory Advertising Services, and Firstory service website.
Content Data You Publish on Firstory Services and its Software/Website: Including but not limited to live streams, posts, photos, and/or short videos that you publish and share. If the data you provide on Firstory Services and its software/website has not been publicly published and shared, such data belongs to your unpublished personal data; please refer to the Firstory Privacy Policy.
Marks/Names Used by Firstory: Refers to Firstory's trademarks including but not limited to any registered, pending registration, or unregistered trademarks, corporate logos, corporate names, trade names, brand logos for goods/services, brand names for goods/services, website names, domain names, or any other representations that highlight Firstory's identity and its goods and services, such as "Firstory," "Firstory Hosting," "Firstory App," "Firstory Inc.," etc.
Data on Firstory Services and its Software/Website: Including but not limited to any data, text, photos, images, graphics, files, information, data, website architecture, website screen arrangements, webpage design, member content, audio and video files, sound effects, musical works, original works, applications, links, and other content or data, all of which are owned by Firstory or legally licensed, including but not limited to trademark rights, patent rights, copyrights, trade secrets/commercial secrets, or proprietary technology.

Intellectual Property Rights and Content Usage Restrictions

No one may directly use, modify, adapt, create derivative works, copy, display, publicly broadcast, publicly transmit, publicly perform, adapt, translate, distribute, publish, publicly release, reverse engineer, decompile or reverse assemble, sell, license, or otherwise use any part. If you wish to quote or reproduce the aforementioned software, programs, or website content, except as clearly permitted by law, you must obtain prior written consent from Firstory or other rights holders in accordance with the law. In case of violation, you shall be responsible for full compensation for damages.

Licensing of User Content

Regarding the content data you publish on Firstory Services and its software/website (as defined), the ownership and intellectual property rights remain with you. However, to maintain service operations, improve service quality, and enable Firstory to promote or publicize Firstory Services through your public content, you agree to grant Firstory the following rights:

License Scope: Global, non-exclusive, unlimited, and royalty-free.
Rights Content:
Firstory may manage, reproduce, distribute, disseminate, and use the data content you publish, for example: storing your content on Firstory's systems so you can access it anytime, anywhere.
Publicly publish, publicly transmit, or publicly display the data content you have made available for others to view.
Modify the data content you publish and create derivative works based on your data content, for example: reformatting your data content or translating it.
License Period: This license remains in effect as long as your published data content is protected by intellectual property rights, until you remove any content covered by this license from Firstory Services.

After you remove the published data from Firstory Services, Firstory's systems will stop making this content public within a reasonable time, except for the following two exceptions:

You have already shared the content with others through the sharing function before removing the data content.
You published the content through another company's services. In this case, your data content may still be displayed or searched through the other company's services.

User Representations and Warranties

You hereby represent and warrant:

You own the content you publish on Firstory Services or through Firstory Services, or otherwise have the right to grant the rights and permissions to reproduce, edit, publicly transmit, adapt, translate, publicly broadcast, publicly publish, publicly screen, distribute, publish, and sublicense the aforementioned content data;
The content published on or through Firstory Services does not violate, abuse, or infringe upon the rights of third parties, including but not limited to privacy rights, agency rights, publicity rights, copyrights, trademark rights, or other intellectual property rights;
You agree to pay all royalties, fees, and any other payments arising from content you publish on or through Firstory Services.

Authorization for Rights Protection

You authorize Firstory Group companies and successor companies to protect the rights to the content you publish on Firstory Services and its software/website in their own name or by commissioning professionals or Cooperative Vendors. Rights protection methods include but are not limited to: monitoring infringement, sending rights protection letters, filing lawsuits or arbitration, mediation, settlement, etc., and have the right to make decisions on rights protection matters and implement them independently. You also agree that Firstory Group companies and successor companies may request you to provide relevant rights certification materials to exercise the aforementioned rights protection. For the avoidance of doubt, you understand that Firstory Group companies and successor companies have the right but not the obligation to take the aforementioned rights protection measures.

Intellectual Property Infringement Handling Principles

When a rights holder discovers that content you published on Firstory Services and its software/website is suspected of infringing their intellectual property rights, the rights holder may provide preliminary evidence sufficient for Firstory to identify the intellectual property rights and provide contact information for the rights holder, and file a complaint with the Firstory customer service email (support@Firstory.me).
After receiving a complaint, if Firstory has doubts about whether the complainant is the rights holder, Firstory may require the complainant to provide proof of rights (such as trademark registration data) and/or a statement (such as the complainant stating that the complaint content is all true, and the complainant is the copyright owner or the copyright owner's agent and guarantees that if the complaint is untrue and causes damage to Firstory or others, the complainant is willing to bear legal responsibility).
Firstory will handle complaints based on the information provided by the complainant, including providing the complainant's (rights holder's) name, email, and the complained content to the complained party (such as the Podcaster), and requiring the complained party to respond and explain the complained matter within a certain period. Firstory will review the information provided by the complainant and the complained party. If it is confirmed that there is indeed an infringement of copyright property rights, Firstory will take reasonable measures to remove the content from Firstory Services as soon as possible.
The personal data of the complained party (such as the Podcaster) is managed by Firstory in accordance with its privacy protection policy. If the complainant (rights holder) wishes to obtain the personal data of the alleged infringer, they should file a complaint/appeal with police/prosecutors/judicial/tax collection authorities or other competent authorities. Firstory will provide the personal data upon receiving a request from a competent authority in accordance with legal procedures.
If content published by Firstory Service users on Firstory Services and its software/website is claimed by the complainant (rights holder) to infringe their intellectual property rights, once the content is removed by Firstory, it cannot be restored.
Infringement of others' intellectual property rights: If the complained party has a record of infringing others' intellectual property rights, Firstory has the right to terminate all or part of the services provided to the complained party.

# Firstory Royalty Redemption Terms of Service

(hereinafter referred to as "Firstory"). Please read carefully to protect your rights. When you use this Service, you are deemed to have read, understood, and agreed to accept all the contents of these Terms of Service. Firstory has the right to modify or change the content of these Terms of Service at any time. It is recommended that you pay attention to such modifications or changes at any time. Your continued use of this Service after any modification or change is deemed that you have read, understood, and agreed to accept such modifications or changes. If you do not agree with the content of these Terms of Service, or if your country or region excludes all or part of the content of these Terms of Service, you should immediately stop using this Service.

If you are under the age of twenty (or have not reached the legal age of majority in your jurisdiction), in addition to complying with the above provisions, you may use or continue to use this Service only after your legal representative (or guardian) has read, understood, and agreed to all the contents of these Terms of Service and subsequent modifications and changes. You also agree that Firstory shall not be liable for damages caused by your linking to websites not belonging to Firstory.

If you link to this Service from another third-party website, you agree to authorize the third-party website to provide your personal data to this Service for use within the scope of service.

Article 3 User's Legal Compliance Obligations and Commitments

You promise never to use this Service for any illegal purpose or in any illegal manner, and promise to comply with relevant laws and regulations of the Republic of China and all international practices for using the Internet. If you are a user outside the Republic of China, you also agree to comply with the laws and regulations of your country or region. You agree and guarantee not to use this Service to engage in acts that infringe upon the rights of others or violate the law, including but not limited to:

Forging message sources or interfering with the identification of transmission sources in any way;
Interfering with or interrupting this Service or servers or networks connected to this Service, or not complying with relevant requirements, procedures, policies, or rules for connecting to this Service;
Tracking others or otherwise interfering with others or collecting or storing others' personal information for the aforementioned purposes;
Other behaviors that Firstory has good reason to believe are inappropriate.

Data Sources

All graphics and text in this Service are protected by copyright laws and belong to Firstory. Firstory provides data related to Firstory.

System Interruption or Failure

This Service may sometimes experience interruptions or failures, which may cause inconvenience in your use, data loss, errors, tampering by others, or other economic losses. You should take protective measures when using this Service. Firstory shall not be liable for any damages caused to you by your use (or inability to use) this Service.

General Measures Regarding Use and Storage

You agree that Firstory may establish general measures and restrictions regarding this Service, including but not limited to the maximum period for which this Service will retain Q&A content, contributed content, or other uploaded content, and the maximum number of times you use this Service within a general specific period (and the maximum duration of each use). If Firstory deletes or fails to store any messages, communications, and content maintained or transmitted by this Service, you agree that Firstory shall bear no responsibility.

You also agree that Firstory has the right to close accounts that have not been used for a long time. You also agree that Firstory has the right to change these general measures and restrictions at any time based on its own considerations, with or without notice. The Firstory customer service email will also store content on Firstory servers. Your agreement to these Terms of Service means that you allow Firstory to store this communication content on its servers.

Information or Advice

Firstory does not guarantee that information or advice obtained through your use of this Service or through other websites linked through the Firstory website (including but not limited to investment and financial management, legal, and other aspects) is completely correct. Firstory has the right to modify or delete the information or advice provided by this Service at any time. Before making any relevant plans and decisions, you should still consult professionals to provide opinions on your situation to meet your individual needs.

Firstory will at any time cooperate with other companies, vendors, and other third parties ("Content Providers") who provide different content including but not limited to news and e-newsletters for Firstory to publish. Out of respect for the intellectual property rights of Content Providers, Firstory does not substantially review or modify the content they provide and is not responsible for the correctness or veracity of such content. You need to judge the correctness and veracity of such content yourself. If you believe that certain content involves infringement or is false, please directly respond to the Content Provider.

Advertising

All advertising content, text and image descriptions, or other sales information you see on the Firstory website are designed and provided by the respective advertisers, product and service suppliers. You should exercise your own judgment regarding the accuracy and credibility of advertisements. Firstory only accepts commissions to publish them and does not guarantee the aforementioned advertisements.

Buying, Selling, or Other Transactions

Vendors or individuals may provide product buying and selling, services, or other transactions through this Service or through other websites linked through the Firstory website. If you engage in transactions with such vendors or individuals as a result, each such buying and selling or other contract exists only between you and each such vendor or individual. You should require each such vendor or individual to explain and clarify in advance the quality, content, warranty matters, and warranty liability for defects of their goods, services, or other transaction objects. Disputes arising from the aforementioned buying and selling, services, or other transaction behaviors should be resolved or remedied by seeking recourse from each such vendor or individual.

Firstory declares that it will never intervene in any buying, selling, service, or other transaction behavior between you and vendors or individuals, and does not bear any warranty liability for the goods, services, or other transaction objects you obtain. If you engage in the aforementioned buying, selling, service, or other transaction behavior with objects operated by Firstory, the rights and obligations of both parties will be separately determined according to the content of Firstory's responsibility specification agreement.

Disclaimer

You expressly understand and agree: This Service is provided on an "as is" and "as available" basis. Firstory will make its best efforts to provide you with services, but you must bear the relevant risks when using this Service. Firstory does not guarantee the following:

This Service will meet your needs;
This Service will be uninterrupted, provided in a timely manner, secure, reliable, or error-free;
The results obtained from the use of this Service will be correct or reliable;
Any products, services, information, or other data you purchase or obtain through this Service will meet your expectations.

Whether to download or obtain any data through the use of this Service should be considered by you at your own risk, and you waive any claims or legal actions against Firstory for any damage to your computer system, network access, download or playback equipment, or data loss caused by downloading any such data. You shall bear full responsibility. Advice and information you obtain from Firstory or through this Service, whether written or oral, does not constitute a warranty of this Service.

You expressly understand and agree that Firstory and its subsidiaries, affiliated enterprises, managers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, derivative, or punitive damages you suffer from this Service, including but not limited to loss of profits, goodwill, use, or data or other intangible losses (even if Firstory has been advised of the possibility of such damages) arising from:

Use or inability to use this Service;
Cost of purchasing substitute goods and services;
Unauthorized access to or modification of your transmissions or data by others;
Statements or actions by any third party regarding this Service;
Anything else related to this Service.

Some jurisdictions do not allow the exclusion of certain warranty liabilities or the limitation or exemption of incidental or derivative damages. In such cases, the aforementioned limitations in this article do not apply to you.

As a third-party information media platform service, this Service merely provides a medium for publishing data and processing information data. Given the nature of the internet, this Service cannot identify or judge the source of objects and whether the published data is authentic. Please verify in advance by both parties to the transaction. Member Behavior

Firstory has not reviewed "Member Content" in advance, but Firstory has the right (but no obligation) to refuse or remove any "Member Content" provided through this Service at its sole discretion. Without limiting the foregoing provisions, Firstory and its designees have the right to remove any "Member Content" that may violate these Terms of Service or laws and regulations or is offensive. When you use any "Member Content," you agree that you must evaluate the accuracy, completeness, or usefulness of the aforementioned "Member Content" yourself and bear all risks.

You understand and agree that Firstory may, based on legal requirements or within the reasonable necessity of the following purposes, deem it necessary to preserve or disclose your account information or "Member Content" to government agencies, judicial police, or guardians of minors, and may preserve and disclose:

Necessary to provide this Service;

Those who join as members using false names or other people's identity information cannot obtain legal protection and must bear all civil and criminal responsibilities for this. Information We Collect

Content you actively provide or make public when using services from Firstory and Firstory's agents, including Podcast programs you upload or related information (such as metadata or file creation dates, etc.).
Download counts and view counts of your Podcast programs.
Interaction information from your communication with others through Firstory Services, including: account names, interaction time and frequency, information shared by other users about you, etc.
Your and your Podcast program listeners' usage of Firstory Services, including the types of programs you view or interact with, platform features used for interaction, people or accounts you interact with, activity time periods, frequency and duration, etc.
If your program listeners have engaged in sponsorship or other financial transactions through the platform, we will collect information related to the transaction, including the types of programs sponsored and sponsorship amounts, etc.

In addition to the above content, we will not actively collect, use, or provide to third parties your personal data such as medical records, sex life, health status, religious beliefs, political tendencies, or criminal records, unless you specifically agree or disclose them yourself.

How We Use the Above Information

Brand owners or advertising agencies cooperating with us will be able to search your account name or program-related information.
